TERMS AND CONDITIONS OF SALE

All sales are subject to the terms and conditions defined in this agreement. This contract is governed by and subject to TEXAS State law. All transactions whether payments, penalties or refunds, are transacted in U.S. Dollars at the rate current at the time of the transaction. We are not responsible and will make no adjustment for exchange rate differences due to currency fluctuations.

 

1. BOOKINGS AND PAYMENTS
   Real Impact Training Systems LLC and Impact REI LLC(referred to as Impact for the remainder of this document) and Unlimited Vacation Clubs (referred to as UVC for the remainder of this document) require payment in full to reserve your accommodations plus full payment of any insurance premium (if applicable). Late bookings will incur the additional costs for updating and confirming your hotel accommodations.

2. AMENDMENTS AND CANCELLATIONS
   
   If you cancel the reservation or change your departure date, duration, class of service, name or hotel for your package, the charges shown below become payable by you.

    

   If you cancel your reservation at least 30 days prior to your check in date, the cancellation fee will be 5% of Total Price. If you cancel your reservation at least 29 and 7 days from the check in date, there will be a two night penalty charge at that date’s rate. If you cancel 6 to one day from the check in date, it will be considered as a no-show and there is a three night penalty charge.

   If you are making three monthly payments the penalties will be taken from the first payment made.

3. AIR CARRIERS– WE WON’T BE OFFERING AIR TRANSPORTATION THIS TIME

IMPACT or UVC won’t be making arrangements for international air transportation to your destination. Neither Transportation to/from the hotel.

ALL FLIGHT TIMES ARE SUBJECT TO CHANGE. IMPACT is neither liable nor responsible for any change or cancellation of your flight.

YOU ARE REQUIRED TO ENSURE THAT YOU HAVE PROPER DOCUMENTATION FOR TRAVEL.   IF YOU ARE DENIED BOARDING AND DO NOT TRAVEL AS SCHEDULED NORMAL CANCELATION PENALTIES AND TERMS & CONDITIONS APPLY.

For Canadian and US citizens: Proof of citizenship is required in the form of a valid passport. PASSPORT IS REQUIRED
For citizens of other countries, please contact your nearest Mexican Consulate.

4. DISPUTE RESOLUTION
   The procedures for and the location of the resolution of disputes must take place in the state of TEXAS.

 

What We Offer In Return

1. PRICE OFFER
Our intention is to provide you with the products that you have selected, at the current price at time of booking. If for any reason (except as a result of U.S. or foreign government taxes or fuel surcharges), we have to increase the price of your vacation, we will offer you the option of cancellation without charge, provided that you advise us within seven days of your receipt of notice of the increase.
Please note:  IMPACT  reserves the right to re-invoice you in case of an error made in computing your price.

All prices and features described herein (as well as in IMPACT and UVC print advertisements and website) are subject to change without notice. Some hotel room photographs do not depict the standard room category.

2. FLIGHT INFORMATION– NOT AVAILABLE THROUGH IMPACT
   IMPACT will require your flight information in order to arrange hotel welcoming details.

 

3. AMENDMENTS & CANCELLATION
   In the unlikely event that a major change involving your resort accommodations becomes necessary, we will notify you as soon as possible. If you find the revised arrangements we offer are unacceptable, you will have the option of cancellation without penalty (all monies paid will be refunded -except for a $20 booking fee-as full vacation certificates good for one year from the original travel date).
   IMPACT and UVC are not responsible for any scheduled airline changes, cancellations, additional fees or non-refundable tickets.
   In the event of a change, we will try to substitute comparable services, but in the event of complete cancellation by us, our only liability will be to refund all monies paid as full vacation certificates good for one year from original travel date.

 

4. REFUNDS
   Any refunds due to you will be made as soon as possible and no later than 30 days after receipt of written cancellation notice. Please note, however, that no refunds will be made for any services provided in the itinerary that you do not use.

Please Note: Insurance premiums are also non-refundable and non-transferable.

 

5. OUR RESPONSIBILITY TO YOU
   IMPACT has made arrangements with UVC and other independent suppliers to provide you with the services you purchase. We have taken all reasonable steps to ensure that proper arrangements have been made for your accommodations. However, we do not accept any liability for the actions or omissions of these independent suppliers, over whom we have no direct control. If you find you have any dispute with such persons, IMPACT will provide you with as much reasonable help as we can in resolving this.
   Please understand that such factors as weather, government actions, mechanical breakdowns, your physical, medical or mental disabilities, your failure to obtain valid travel documents or your failure to follow travel instructions are outside the control of IMPACT. We are not responsible for losses or damages arising from physical or emotional injury, property or other economic damage caused by such factors beyond our control.

In addition, IMPACT is not responsible for any consequential damages or monetary losses due to flight delays, currency conversion rates or other unforeseen circumstances. Of course, we remain responsible for any negligent actions on our part.

6. HANDICAPPED FACILITIES
   Wheelchair accessible rooms may be requested, but cannot be guaranteed.  Standards may vary from property to property and country to country and are not within the control of UVC.  Additionally, UVC cannot guarantee the availability of wheelchairs at any airport.

 

7. VACATION INSURANCE PLAN
   Protect your travel investment with the purchase of our optional Vacation Insurance Plan. This plan safeguards your travel investment against penalties due to trip cancellation or interruption, baggage, medical expense or travel assistance. I understand that if I purchase the Vacation Insurance Plan, my refund for any applicable cancellation penalties will be in Travel Certificates. The insurance plan payment will be deducted from any refund. Please request cost of Insurance Plan to norma@vmiproperties.com.

Real Impact Training LLC is simply an intermediary between the UVC and other travel agencies and the public. Real Impact Training LLC does not own or operate any, hotels, shore excursions, transportation providers, airlines, travel protection companies, attractions, or other travel-related Suppliers who provide goods or services for the Passenger(s)’ trip. Passenger(s) acknowledge and agree that Real Impact Training LLC shall not be responsible for any loss, damage, delay, inconvenience, or injury to Passenger(s) or group members as a result of a breach of contract, act or omission whether willful or negligent, criminal or otherwise of any
person other than Real Impact Training LLC or its direct employees, including but not limited to these Suppliers, their employees, agents, servants, or representatives.

 

Real Impact Training LLC recommends that all Passengers be in good physical and mental health and have medical approval to travel.

You are required to ensure that you have proper documentation for travel.   If you are denied boarding and do not travel as scheduled normal cancelation penalties and terms & conditions apply.

Without limitation, Passenger(s) assume the risk of and agree that Real Impact Training LLC is not liable for any damages arising from or related to any act of God or public enemies, arrest, restraints of any government or rulers of people, piracy, war, revolution, extortion, terrorist activity, threatened or actual rebellion, political upheaval, civil unrest, riots, fire, lockouts, explosion, collision, weather conditions, dangers incident to the sea, mechanical or construction failures or difficulties, diseases, local laws, abnormal conditions or developments, closure of airports/seaports/hotels/train stations, carrier or supplier logistical problems, computer problems stranding, food or water poisoning, illness, grounding, perils of the sea, rivers, canals, locks or other waters, perils of navigation of any kind, theft, accident to or from machinery, boilers, or latent defects even though existing at the commencement of the trip, desertion or revolt of the AMR Staff, or lost/damaged/delayed luggage.

 

Real Impact Training LLC have made arrangements with UVC and other independent vendors to provide you with excellent service.  We have taken all reasonable steps to ensure that proper arrangements have been made for your stay.  However, we do not accept any liability for the actions or omissions of these vendors over whom we do not have control.  If you have a dispute with these vendors, Real Impact Training LLC will provide you with as much help as possible to resolve your issue.  

 

Real Impact Training LLC is not responsible for any losses or damage arising from emotional or physical injury. We are not responsible for any personal property damage.

You are responsible for your airfare to Mexico.  This will be purchased by you for an additional cost.  Real Impact Training LLC is not responsible for any consequential damages or monetary losses due to flight delays, currency conversion rates, or other unforeseen circumstances.

 

The Terms and Conditions may be amended or modified by Real Impact Training LLC at any time without notice. It is therefore essential that you consult the Terms and Conditions prior to making each and every booking, particularly in order to ensure what provisions are in operation in case they have changed since the last time an order was placed by you. The failure of Real Impact Training LLC to act with respect to a breach of these Terms and Conditions by you, or others, does not waive its right to act with respect to subsequent or similar breaches. Real Impact Training LLC does not guarantee they will take action against all breaches of this these Terms and Conditions.

Severability: If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions.
